These Terms govern the use of Convomint — a SaaS platform for employee reviews, surveys and development. By registering an account or using the Service you accept the terms below.
1. General provisions and definitions
The Service Convomint is provided by Abersite Artur Bereśniewicz, ul. Kobryńska 19, 15-722 Białystok, Poland, tax ID (NIP): 847 134 90 60 (the "Operator"). Contact: [email protected] (contact details also on the Contact page).
"Service" means the Convomint platform including the application, admin panel and employee portal. "Customer" means the entity that entered into the service agreement (usually the employer). "User" means a natural person using the Service under a Customer account. The Service is aimed at businesses (B2B); provisions concerning consumers and sole traders with consumer rights apply only where such status arises by operation of law.
2. Scope of the service
Convomint provides, on a subscription basis, a platform for multi-rater reviews (90°–360°+), employee surveys (including pulse and eNPS), results reporting, and employee development (development plans, continuous feedback, kudos). The feature scope depends on the subscription plan described in the pricing.
The Operator may offer a free trial and a demo environment with sample data. The demo serves product evaluation only — data entered there is periodically erased and is not subject to Customer data retention obligations.
The Service is hosted on infrastructure located in the European Union.
3. Accounts and access security
The Customer appoints administrators responsible for managing users and permissions within its organisation. Credentials must not be shared with third parties; actions performed after correct authentication are deemed actions of the Customer. The Customer grants access in line with its internal confidentiality rules — the Service stores organisationally sensitive data (review results, survey responses, notes, development plans).
4. Payments and subscriptions
Subscriptions are billed in advance, monthly or annually, at the prices applicable at the time of purchase. Payments are handled by Stripe; VAT is added as required by law. Invoices are issued using the details provided by the Customer.
For 14 days from registration you can start new processes, with no card and no automatic charge. After that, processes with a deadline run to the end. Automated processes (recurring, onboarding, offboarding) hold new starts and invitations until a plan is chosen. Access to results and data remains until the account is deleted or as the retention rules provide. Accounts created before this change took effect can start new processes until 6 December 2026. Switching to a paid plan is the Customer's decision. You can cancel your subscription at any time from the panel; cancellation takes effect at the end of the paid billing period, and access remains active until then.
We will announce price changes at least 30 days in advance; a change applies from the next billing period. In the event of non-payment we may restrict or suspend access to paid features after prior notice.
5. Right of withdrawal (consumers and sole traders with consumer rights)
If you enter into the agreement as a consumer, or as a sole trader for whom the contract is not of a professional character (art. 38a of the Polish Consumer Rights Act), you may withdraw from a distance contract within 14 days of its conclusion without giving a reason. To withdraw, send an unequivocal statement to [email protected] — you may use the statutory model withdrawal form (Annex 2 to the Consumer Rights Act), but it is not obligatory.
By purchasing a paid plan you give your express consent to the performance of the service beginning before the withdrawal period expires (by ticking the relevant box during checkout); a confirmation of the contract together with this notice is sent to you by e-mail after purchase. If you then withdraw within 14 days, you pay an amount proportional to the time elapsed from the paid billing period until withdrawal, and we promptly refund the remainder. The right of withdrawal expires once the service has been fully performed (i.e. at the end of the paid billing period), which you consent to and acknowledge before performance begins.
We issue refunds without undue delay, no later than 14 days after receiving the withdrawal statement, using the same payment method used for the purchase, at no extra cost.
The right of withdrawal does not apply to Customers contracting within a business of a professional character (standard B2B). Independently of the withdrawal right, every Customer may cancel the subscription at any time as described in section 4.
6. Acceptable use and sending limits
The platform may only be used as intended — to run feedback and survey processes within your own organisation. It must not be used to send unsolicited, misleading, or bulk messages to recipients with whom you have no relationship. To protect deliverability for all customers, e-mail sending is subject to fair-use limits that depend on your plan; we may throttle or suspend sending that exceeds those limits or shows signs of abuse. We may also apply additional anti-spam safeguards (e.g. verification and rate limits) on public forms and in the panel.
7. Customer data and data processing
All data entered into the Service by the Customer and its Users remains the Customer's property. For personal data of the Customer's employees and associates processed in the Service, the Customer is the data controller and the Operator is the data processor (art. 28 GDPR). The Operator processes such data solely to provide, maintain and develop the service, following the Customer's documented instructions.
Detailed processing terms (subject-matter, duration, data categories, obligations, sub-processing) are set out in the data processing agreement, available on request at [email protected]. The list of subprocessors is described in the Privacy Policy; we announce material subprocessor changes in advance, allowing objection.
After the agreement ends, the Customer may export its data within 30 days (reports and results in CSV/PDF among others). After that period the data is deleted or anonymised, unless the law requires longer retention.
8. AI features — supportive character
The Service offers features that use language models (template generation, report summaries, comment analysis). Their output is auxiliary and informational only: it constitutes suggestions and recommendations, not determinations. Decisions about employees are always made by a human on the Customer's side.
The Customer undertakes not to make decisions concerning evaluated persons based solely on automated processing (art. 22 GDPR). The Operator does not warrant that AI-generated content is free of inaccuracies — it must be reviewed before use.
9. Intellectual property
The Service, its code, design, documentation and trademarks are the property of the Operator or its licensors. The Customer receives a non-exclusive, non-transferable licence to use the Service during the subscription period, within the purchased plan. By providing product feedback or suggestions, the Customer agrees to their free use in developing the Service.
10. Service availability and support
We maintain Service availability at a commercially reasonable level, allowing short maintenance windows (planned work is announced in advance where possible). Technical support is provided by e-mail ([email protected]) on business days; higher plans receive priority handling as per the pricing.
11. Liability
Towards Customers who are not consumers, the Operator's total contractual liability is limited to the fees paid by the Customer for the service in the 12 months preceding the event giving rise to the damage. The Operator is not liable for indirect damages, lost profits, data loss caused by the Customer's actions, or the consequences of personnel decisions made on the basis of data from the Service.
These limitations do not apply to damage caused intentionally or to other cases where limiting liability is not permitted by law. For consumers and sole traders with consumer rights, generally applicable law prevails — this section does not limit their statutory rights.
12. Term and termination
The agreement runs for the subscription period and renews for subsequent periods until cancelled. The Operator may terminate the agreement or suspend access with immediate effect in the event of a material breach of these Terms (in particular section 6) after an ineffective demand to cease, or where required by law. After termination, the data export and deletion rules of section 7 apply.
13. Changes to these Terms
We may amend these Terms for important reasons (changes in law, features, security rules or the business model). We will announce changes by e-mail or in the panel at least 14 days before they take effect. If you do not accept the changes, you may terminate the agreement before the effective date; continued use of the Service after that date constitutes acceptance.
14. Governing law and disputes
These Terms are governed by Polish law. Disputes with non-consumer Customers are resolved by the common courts competent for the Operator's registered office. For consumers, court jurisdiction follows general rules; consumers may also use out-of-court dispute resolution (including municipal or district consumer ombudsmen and Voivodeship Inspectorates of Trade Inspection).
